Lately, many in our community have called, fearful and uncertain about their rights if detained by ICE. In these times, knowledge is your strongest shield. Here’s what every immigrant and their family should know.
If ICE Is at Your Door: 5 Rules to Remember
You have rights. It is critical that you and your family know them:
- Do Not Open Your Door – An agent needs a warrant signed by a judge to enter. Ask them to slide it under the door. If they don’t have one, you have the right to keep your door closed.
- You Have the Right to Remain Silent – You do not have to answer questions. Simply state, “I exercise my right to remain silent.”
- Do Not Sign Anything – Never sign papers from an agent without first speaking to your lawyer.
- Do Not Lie – Never provide false documents or information. It is better to remain silent.
- Ask for a Lawyer Immediately – Clearly state, “I want to speak with my lawyer.” This is the most important thing you can do to protect yourself.
The Most Important Plan: Your Family Emergency Plan
One of the biggest fears is what happens to your children or property if you are detained. A Family Emergency Plan is the answer. We strongly recommend:
- Temporary Guardianship – This legal document lets you name a trusted person to care for your minor children if you are detained or deported, keeping them safe and out of foster care.
- Temporary Power of Attorney – This allows a trusted person to manage your property, bank accounts, and other assets if you cannot.
